Terms of Service

These Terms of Service (“Terms”) govern your access to and use of FlitIQ (“Service”), operated by SmartLink Basics, LLC (d/b/a FlitIQ) (“we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use FlitIQ. By using the Service you represent that you meet these requirements.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@flitiq.com if you suspect unauthorized access.

3. Subscriptions & Billing

FlitIQ offers free and paid tiers. Paid subscriptions are billed monthly at the rate displayed at the time of purchase. On iOS, billing is processed through Apple’s App Store; on the web, billing is processed through Stripe. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.

You may cancel at any time through your App Store subscription settings or through the account page on the web. Refunds are handled in accordance with Apple’s or Stripe’s respective refund policies.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Scrape, crawl, or programmatically extract data from the Service beyond normal use of the provided interface and APIs.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Resell, redistribute, or sublicense access to the Service without written permission.

5. Data Sources & Accuracy

FlitIQ aggregates data from publicly available FMCSA sources. While we strive for accuracy, we do not guarantee that data is complete, current, or error-free. You acknowledge that carrier safety scores, inspection records, and authority information may change and should be independently verified before making business decisions.

6. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, and software — are owned by SmartLink Basics, LLC (d/b/a FlitIQ) and protected by intellectual property laws. You retain ownership of any data you input into the Service (notes, pipeline stages, etc.).

7. Limitation of Liability

To the maximum extent permitted by law, SmartLink Basics, LLC (d/b/a FlitIQ) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Termination

We may suspend or terminate your access at any time for violation of these Terms or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, and 10 survive termination.

10. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in King County, Washington.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date. Continued use of the Service after changes constitutes acceptance.
